A Qualified Domestic Relations Order (QDRO) is a court order that establishes the right of an alternate payee (usually a former spouse) to receive all or a portion of the benefits payable under a retirement plan.

California is a community property state, meaning that marital property is generally divided equally between spouses upon divorce. Retirement benefits earned during marriage are considered community property and are subject to division.
